DEFINITIONS: The following bold terms, which you will often find starting with upper case even in the middle of the text, are defined as follows:

Publisher: The legal entity responsible for the publishing and content of the Platform (First Intermediary e-Commerce Ltd)

Member: Anyone who registers on the Platform.

User: Anyone who visits and uses the Platform.

Platform: The functional and organizational structure set up by MYGOODEALS which allows the linking of professional Partners and Buyers by selling coupons and accessible via the Site https://www.mygoodeals.net/. It will be designated either by Platform or simply by MYGOODEALS.

Terms: These Terms and Conditions of Use.

Coupon: Printable electronic document sold on the platform that allows its beneficiary to use within a specified period of time to use the services or purchase a good or product at a negotiated rate with Partners.

Partner: Professional member offering his Services or Goods through the sale of Coupons on the Platform.

Buyer: User who buys a Coupon for a Service or a Product of a Partner via the Platform MYGOODEALS.

You: Any user or member of the platform to whom is addressed these Terms.

We or Us: The publisher of MYGOODEALS Platform.

 

Please read these Terms carefully.You can print or save it at your convenience. You acknowledge that you have read it and accept it in its entirety and unreservedly.

 

GENERAL INFORMATIONS

These terms and conditions of Use will be regularly referred to as Terms. References to the Platform publisher(the Company INTERMEDIARY FIRST E-COMMERCE LIMITED) will be referred to as “we”   and the platform members and website visitors will be referred to as "you".

These Terms are a contract that you agree by browsing the Platform or registering as a Member.

This site and its dedicated mobile application is a platform on which we list product offers in the form of coupons. We act exclusively as an intermediary to enable service partners and product sellers to carry out transactions directly with buyers.

The Partner's and the platform are not bound by contractual obligations that since we put at your disposal, as part of these Terms, a technology platform to achieve Coupon sales. 

In this respect, there is no sales contract between the Platform and the Buyer; the sales contract is established between the Partner and the Buyer.

These Terms will therefore govern the relationship between our Platform and its users, Partner and Buyers, under the use of the technical service of the Platform and the marketing of your Products through this service.

You agree at take knowledge and to respect the rules stipulated in the present Terms and the Privacy policy as well as any other instructions communicated by the Platform for all use ofservice offered by MYGOODEALS.

The Terms that apply to you are those that appear on the Platform on the day of registration as a member of the Platform.

The Platform reserves the right to make changes to these and you will be informed by email, three (3) and seven (7) working days before the date of entry into force of the modified Terms.You are free to accept the changes or terminate your use of the MYGOODEALS service.

 

REGISTRATION AND ACCOUNT ON THE PLATFORM

Access to MYGOODEALS services is conditioned by the registration of the user. The registration and access to the services of the site are reserved exclusively for adults who have completed and validated the registration form available on the Platform. You can only have one account. MYGOODEALS will be able to close the account or the accounts which would have been opened in violation of this rule without possibility to make a new request for opening of account.

When you register, you agree to provide accurate, sincere and update information. Take care to check by your own to maintain accuracy. You must therefore provide a valid email address, on which the Platform will provide you with a confirmation of registration to its services. The Platform assigns you an ID allowing you to access a space whose reserved involving to enter your password.

The ID is definitive but the password can be changed online in your Personal Area. The password is confidential; you may not to communicate it to others.

MYGOODEALS may refuse an application for registration to services in case of non-compliance with these Terms.

The publisher reserves the right to remove the personal space of any Member who contravenes these terms of use and sale and in particular in the following cases:

• If the user makes an illegal use of the site;
• If the user, during the creation of his personal space, voluntarily transmits incorrect information to the site;
• If the user has not been active on his personal space for at least one year.

In the event that MYGOODEALS decides to delete your personal space for one of these reasons, this one cannot constitute damage for the user whose account has been deleted. This deletion cannot constitute a waiver of judicial action that the Platform may take against the user who has contravened these rules.

MYGOODEALS reserves the right to request supporting documents if necessary.

Your account registration is for an indefinite period until you decide to close it.

 

TERMS OF CLOSURE AND TERMINATION OF MEMBERSHIP

You can at any time unsubscribe you on the dedicated page in your e personal space. 

Any unsubscription from the site will be effective within the 7 working days.

In the event of termination by either Party for any reason, you lose your membership of the Platform.

 

OBLIGATIONS AND LIMITATIONS OF LIABILITY OF MYGOODEALS

The platform implements all the means at its disposal to provide the services covered by these Conditions but does not guarantee that the MYGOODEALS Platform and its associated services are permanently available.

The Platform is not responsible for information relating to the Products being sold or services proposed, including the veracity, accuracy and completeness of their description.

In no event shall the Site be held liable for any indirect damage such as loss of sales or profits, loss or alteration of data, damage to the image, etc.

The limitation of liability referred to above is inapplicable:

• in case of fraud or gross negligence of the website ;
• In case of bodily injury, claims based on liability for defective products.

 

INDEPENDENCE OF THE PARTIES

MYGOODEALS and its Partners will not be considered as related a common entity any. The Partners carry out their activity in all autonomy and are responsible for the transaction made directly with the Coupon Buyer.

 

USER RESPONSIBILITY

The User expressly agrees to use the Platform at his own risk and under his sole responsibility. The Platform provides the User with information for information purposes, with imperfections, errors, omissions, inaccuracies and other ambivalences that may exist. In any case, MYGOODEALS can in no way be held responsible:

Ø  any direct or indirect damage, in particular with respect to loss of profits, loss of profits, loss of customers, data that may result from the use of the Platform, or the impossibility of its use ;

Ø   Malfunction, unavailability of access, misuse, misconfiguration of the User's computer, or the use of a browser that is not used by the User;

Ø  Content of advertisements and other links or external sources accessible by Clients from the Platform.

 

HYPERTEXT LINKS

The Platform may include hypertext links to other sites.

Publisher’ liability may not be invoked for any damage or loss proven or alleged, consecutive to or in connection with the use or having read the contents, advertisements, products or services available on these sites or external sources. Similarly, the Publisher’s liability may not be held invoked if your visit to one of these sites causes you harm.

If, despite the efforts of the Publisher, one of the hypertext links on the Platform pointed to a website or an internet source whose content was or did not appear to comply with the requirements of law, you agree to immediately contact the publication manager of the Platform, whose details appear in the legal notice hereabove, in order to communicate to him the address of the pages of the Platform third party in question.

 

ACCESS AND AVAILABILITY OF THE PLATFORM

The Publisher makes its best efforts to make the Platform permanently accessible, subject to the maintenance operations of the Platform or servers on which it is hosted. In case of impossibility of access to the website, because of technical problems or all kinds, you will not be able to claim any compensation for damages.

The Publisher of the Platform is held only by an obligation of means; its liability cannot be invoked for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, rupture of the service, or others.

You expressly agree to use the Platform at your own risk and under your sole responsibility.

The Platform provides you with indicative information, with shortcomings, errors, omissions, inaccuracies and other ambivalences that may exist. In any case, MYGOODEALS can in no way be held responsible:

INTELLECTUAL PROPERTY RIGHTS

All elements of this Site belong to the Publisher or a third party agent, or are used by the Publisher on the Platform with the authorization of their owner.

Any representation, reproduction or adaptation of logos, textual, pictographic or video content, without this enumeration being exhaustive, is strictly prohibited and is similar to counterfeiting.

Any User who is guilty of infringement could have your access to the site deleted without notice or compensation and without this exclusion can be constitutive of damage, without reservation of possible subsequent legal proceedings against you, to the Publisher's initiative of this Site or your agent.

The present Site uses elements (images, photographs, contents) whose credits return to: the couturiers / creators will put on line their own photos.

 

PROTECTION OF PERSONAL DATA

NOTIFICATIONS AND CLAIMS

Any notice or opinion concerning these Terms and legal notices must be made in writing and sent by registered to mail address indicated in the legal notice, or by mail to contact@mygoodeals.net, specifying the contact details, surname and first name, as well as the subject of the message. For a notification about the privacy policy on personal data you can send an e-mail to: privacy@mygoodeals.net

It may be possible, throughout the web platform and the services offered, and to a limited extent, inaccuracies or errors, or information that disagrees with the Terms the legal notice or the privacy policy. In addition, it is possible that unauthorized modifications are made by third parties on the Platform or related Services (social networks ...).

 In the event that such a situation eludes us, you have the possibility to contact the Publisher of the Platform to the address and email indicated in the legal notice of the Platform, with a description of the error and if possible a link, as well as sufficient information to contact you. The Publisher can in no way be held responsible for any damage that may occur on your computer system and / or loss of data resulting from the use of the Platform.

The Publisher undertakes to constantly update the content of the Platform and to provide Users with accurate, clear, accurate and up-to-date information. The Platform is in principle always accessible, except during technical maintenance and updating of the content. The Publisher cannot be held liable for damages resulting from the unavailability of the Platform or parts there of.

MISCELLANEOUS

Any clause in these Terms that may be declared null or illegal by a competent judge shall be null and void, but its invalidity shall not affect the other stipulations or affect the validity of these Terms as a whole or their legal effects.

The fact that the Platform has not required the application of any provision of these Terms or that it has tolerated any failure in the course of your activities on the Platform, whether permanently or temporarily, cannot under any circumstances be considered as a waiver of the rights of the Site to use it.

The Parties shall not be held liable, or considered to have failed, for any delay or non-performance where the cause of the delay or non-performance is related to a case of force majeure, as defined by French case law.
